PROPOSED DAVAO (BANGOY) INTERNATIONAL AIRPORT

SAFETY ORDINANCE OF 2007

 

Be it enacted by the City Council, in session assembled that:

 

Section 1 – TITLE – This Ordinance shall be known as the Davao (Bangoy) International Airport Safety Ordinance of 2007;

 

Section 2 – STATEMENT OF POLICY – It is the policy of the City Government of Davao in cooperation with the Air Transport Office (ATO) and other agencies to ensure the safety and security at the airport and all its users such as aircrafts, crews and passengers, as well as residents at its perimeter. It shall likewise the policy to adhere to international standards to make the airport attractive to airlines and visitors as the gateway of the country in southern Philippines.

 

Section 3 – SAFETY MEASURES & PROHIBITED ACTS - To ensure the safety and security of the airport, aircrafts, crews, passengers and residents at the perimeter of the airport complex, the following safety measures and prohibited act shall be enforced:

 

a)    No kite/s, balloon/s, remote controlled plane/s shall be flown or caused to be flown within the distance of 5 Kilometers radius from the fence of the airport and within 12 Kilometers (7.5 Nautical Miles) of the final approach of Runway 23 on Barangay Sasa and Runway 05 on Barangay Anglionto and Barangay Buhangin;

b)    No person/s shall be allowed to raise doves or pigeons within the distance of 5 Kilometers radius from the fence of the airport unless placed in safe and secured cage/s.

c)     No person/s, vehicle/s, animal/s of any kind shall enter or loiter or be allowed to enter within the premises of the airport and other designated areas of the airport complex such as the Ramp, Perimeter Road, Runway, and General Aviation Areas without the permission from the ATO.

d)    No person/s shall be allowed to play or cause to play any remote controlled cars or vehicles at the airport tarmac, runway and other areas without the permission of the ATO.

e)    No person/s shall be allowed to act as porter/s, or canvass or solicit passenger/s coming from commercial flights within the premises of the airport without the permission from the ATO.

f)      No person/s shall be allowed to engage in any form of business within the premises of the airport without permission from the ATO and necessary permits from the city government.

g)    Safety measures and procedures adopted by ATO and airport security agencies particularly inside the airport and on crews, passengers, luggage and cargo shall likewise be enforced accordingly.

 

Section 4 – PENALTY – Any person, or in the case of corporations, partnerships or associations their President or Manager, found guilty of violating any provisions of this Ordinance shall be imposed with the following penalties:

 

First Offense – Fine of One Thousand Pesos (P1,000) or imprisonment of 15 days or both at the discretion of the Court;

 

Second Offense – Fine of Three Thousand Pesos (P3,000) or imprisonment of 15 days or both at the discretion of the Court;

 

Third Offense – Fine of Five Thousand Pesos (P5,000) or imprisonment of 30 days or both at the discretion of the Court;

 

Section 5 – IMPLEMENTATION – The City Mayor in coordination with the ATO, Barangay Councils in the affected areas, and other agencies shall formulate the necessary Implementing Rules & Regulations to effect the proper and orderly implementation of this Ordinance.

 

Section 6 – PUBLIC INFORMATION – The general public shall be notified of this Ordinance through a public information, education and communication program, including appropriate signages at the airport, among others.

 

Section 7 – SEPARABILITY CLAUSE – If any provision of this Ordinance is declared invalid or unconstitutional, such sections or parts not affected shall remain in force and effect.

 

Section 8 – REPEALING CLAUSE – All Ordinances, particularly Ordinance No. 44, series of 1955, and rules and regulations inconsistent with the provisions of this Ordinance are hereby repealed or amended accordingly.

 

Section 9 – EFFECTIVITY – This Ordinance shall take effect immediately upon approval and compliance with provisions on this regard with the Local Government Code.
